FireTAG Connect — Terms of Service

1. Who we are and what these terms cover

These Terms of Service ("Terms") are a legal agreement between FireTag Technologies Ltd. ("FireTAG", "we", "us", "our"), located at #530 – 130 Brew Street, Port Moody, British Columbia V3H 0E5, Canada, and you, the person or organization that creates an account or uses FireTAG Connect (the "Service"), a customer portal at connect.firetag.ca that lets fire-safety customers view and manage information about their equipment, inspections, service orders, and related records.

By creating an account, clicking "Create account", or using the Service, you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you are authorized to bind that organization.

4. The Service

The Service provides a self-service portal to view compliance status, equipment, locations, service history, service requests, and related documents, and to manage additional portal users for your organization. Features may change over time.

The Service is an informational and record-keeping tool. It is not a substitute for professional inspection, testing, or compliance with applicable fire codes, standards, or laws. Compliance remains the responsibility of the Customer and its Service Provider.

FireTAG's compliance-related features (including automated status indicators, expiry calculations, and equipment status shown in the Service) are informational tools based on data entered by the Customer or its Service Provider and do not constitute a certification, inspection, or legal determination of compliance with any fire code, standard, or law. The Customer and its Service Provider remain solely responsible for the accuracy of records and for compliance with applicable codes and regulations.

You agree not to: (a) access data you are not authorized to access; (b) attempt to breach security or disrupt the Service; (c) reverse engineer or copy the Service; (d) use the Service unlawfully or to infringe others' rights; or (e) upload malicious code.

10. Intellectual property

The Service, including its software, design, and trademarks (including "FireTAG" and "FireTAG Connect"), is owned by FireTAG or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service, and no other rights.

11. Third-party services

The Service integrates with third parties (e.g., Stripe for payments, Google Analytics for analytics). Your use of those services may be subject to their terms and privacy policies.

12. Electronic communications and anti-spam (CASL)

By creating an Account you consent to receive transactional electronic messages necessary to operate the Service (e.g., account activation, billing, and service notices). We will send commercial electronic messages (marketing/promotional) only in accordance with Canada's Anti-Spam Legislation (CASL) — with appropriate consent, sender identification, and a working unsubscribe mechanism in each message. You may opt out of marketing messages at any time.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that records shown are complete or accurate.

14. Limitation of liability

To the maximum extent permitted by law, FireTAG's total liability arising out of or relating to the Service will not exceed the amounts you paid to FireTAG in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages.

15. Indemnification

You agree to indemnify FireTAG against claims arising from your misuse of the Service or violation of these Terms, to the extent permitted by law.

16. Term and termination

We may suspend or terminate your Account for breach of these Terms or non-payment. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

If you change your Service Provider, your Content and equipment records remain associated with your FireTAG customer account and are not deleted. Access to your Content is reassigned to your new Service Provider upon your request or your new Service Provider's verified association with your customer account; your prior Service Provider's access is revoked accordingly.

17. Changes to these Terms

We may update these Terms. We will post the updated version and update the "Last updated" date, and, for material changes, provide reasonable notice by email to the address on your Account and, where practicable, an in-app notice. Continued use after changes take effect constitutes acceptance.

18. Language (Quebec)

If we offer the Service to consumers in Quebec, these Terms, the Privacy Policy, and the sign-up flow may be required to be available in French under the Charter of the French Language (Bill 96).

19. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
