FireTAG Connect — Terms of Service
1. Who we are and what these terms cover
These Terms of Service ("Terms") are a legal agreement between FireTag Technologies Ltd. ("FireTAG", "we", "us", "our"), located at #530 – 130 Brew Street, Port Moody, British Columbia V3H 0E5, Canada, and you, the person or organization that creates an account or uses FireTAG Connect (the "Service"), a customer portal at connect.firetag.ca that lets fire-safety customers view and manage information about their equipment, inspections, service orders, and related records.
By creating an account, clicking "Create account", or using the Service, you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you are authorized to bind that organization.
2. Definitions
- "Account" — the portal account you create to access the Service.
- "you" / "Customer" — the owner of the fire-safety equipment (for example, a business, building owner, or facility manager) who registers for and uses the portal.
- "Service Provider" — the fire-safety company that inspects, services, or maintains your equipment and whose records connect to your Account.
- "Subscription" — a paid or free plan governing your access to the Service.
- "Content" — data shown in or submitted to the Service (e.g., equipment records, inspection notes, uploads).
3. Eligibility and account registration
- You must have reached the age of majority in your province of residence (19 in British Columbia) and be able to form a binding contract.
- Registration requires verifying ownership of at least one piece of equipment via a valid serial number associated with a Customer record.
- You agree to provide accurate, current information and to keep your credentials confidential. You are responsible for activity under your Account.
- We may require email verification (account activation) before granting access.
4. The Service
The Service provides a self-service portal to view compliance status, equipment, locations, service history, service requests, and related documents, and to manage additional portal users for your organization. Features may change over time.
The Service is an informational and record-keeping tool. It is not a substitute for professional inspection, testing, or compliance with applicable fire codes, standards, or laws. Compliance remains the responsibility of the Customer and its Service Provider.
FireTAG's compliance-related features (including automated status indicators, expiry calculations, and equipment status shown in the Service) are informational tools based on data entered by the Customer or its Service Provider and do not constitute a certification, inspection, or legal determination of compliance with any fire code, standard, or law. The Customer and its Service Provider remain solely responsible for the accuracy of records and for compliance with applicable codes and regulations.
5. Subscription plans, fees, and taxes
- The Service is offered under several plans (e.g., Free, Trial, Starter, Pro, Enterprise), as described on our pricing page or applicable Order Form, billed monthly or annually, in Canadian dollars (CAD), plus applicable taxes.
- Each Subscription plan includes a defined number of equipment records and a defined number of included portal users ("Plan Limits"), as set out on our pricing page or your Order Form. Use beyond your Plan Limits (e.g., additional portal users, or equipment beyond your plan's limit) may result in additional fees or require an upgrade to a higher plan.
- Prices, Plan Limits, and plan features are shown at checkout and may change on a prospective basis with notice as described in Section 17.
- Free and Trial plans may have limits and may be modified or discontinued.
6. Payment, authorization, and automatic renewal
- You may pay for a paid subscription by credit/debit card or by bank transfer, cash, or cheque, as offered at checkout.
- Card payments are processed by Stripe, Inc. ("Stripe"). We do not store full payment card numbers; card data is handled by Stripe under its own terms and privacy policy. For card payments, you authorize us (via Stripe) to charge your payment method for the subscription fees, including recurring charges for each billing period until cancellation.
- Bank transfer, cash, or cheque payments are invoiced by us; your subscription is activated once payment is received and confirmed.
- Automatic renewal: card-based subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled before renewal. Subscriptions paid by other methods are renewed by a new invoice each period. At sign-up we disclose the recurring amount and billing frequency. We will send a renewal reminder before each annual renewal. For monthly subscriptions, no advance reminder is sent before each billing cycle; a receipt or invoice is provided after each charge.
- Failed or overdue payments may result in suspension or downgrade of the Account.
7. Cancellation, refunds, and consumer rights
- You may cancel your subscription at any time from your account settings or by contacting us; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Except where required by law, fees paid for your first paid billing period are refundable if requested within 14 days of the initial charge. All other fees, including renewal charges and fees for subsequent billing periods, are non-refundable.
- Nothing in these Terms limits any non-waivable rights you have under applicable provincial consumer-protection legislation (including any statutory cancellation or cooling-off rights).
8. Customer data and content
- As between you and FireTAG, Customer Content belongs to the Customer.
- You grant us a limited license to host, process, and display Content solely to provide and improve the Service. Our handling of personal information is described in our Privacy Policy.
- Equipment and service records may originate from your Service Provider; accuracy of such records is the responsibility of the party that created them.
9. Acceptable use
You agree not to: (a) access data you are not authorized to access; (b) attempt to breach security or disrupt the Service; (c) reverse engineer or copy the Service; (d) use the Service unlawfully or to infringe others' rights; or (e) upload malicious code.
10. Intellectual property
The Service, including its software, design, and trademarks (including "FireTAG" and "FireTAG Connect"), is owned by FireTAG or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service, and no other rights.
11. Third-party services
The Service integrates with third parties (e.g., Stripe for payments, Google Analytics for analytics). Your use of those services may be subject to their terms and privacy policies.
12. Electronic communications and anti-spam (CASL)
By creating an Account you consent to receive transactional electronic messages necessary to operate the Service (e.g., account activation, billing, and service notices). We will send commercial electronic messages (marketing/promotional) only in accordance with Canada's Anti-Spam Legislation (CASL) — with appropriate consent, sender identification, and a working unsubscribe mechanism in each message. You may opt out of marketing messages at any time.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that records shown are complete or accurate.
14. Limitation of liability
To the maximum extent permitted by law, FireTAG's total liability arising out of or relating to the Service will not exceed the amounts you paid to FireTAG in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages.
15. Indemnification
You agree to indemnify FireTAG against claims arising from your misuse of the Service or violation of these Terms, to the extent permitted by law.
16. Term and termination
We may suspend or terminate your Account for breach of these Terms or non-payment. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
If you change your Service Provider, your Content and equipment records remain associated with your FireTAG customer account and are not deleted. Access to your Content is reassigned to your new Service Provider upon your request or your new Service Provider's verified association with your customer account; your prior Service Provider's access is revoked accordingly.
17. Changes to these Terms
We may update these Terms. We will post the updated version and update the "Last updated" date, and, for material changes, provide reasonable notice by email to the address on your Account and, where practicable, an in-app notice. Continued use after changes take effect constitutes acceptance.
18. Language (Quebec)
If we offer the Service to consumers in Quebec, these Terms, the Privacy Policy, and the sign-up flow may be required to be available in French under the Charter of the French Language (Bill 96).
19. Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
